Terms of Service

1. Acceptance

By accessing or using AlignEQ services, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization.

2. Services

AlignEQ provides an organizational intelligence platform that processes HR assessment data, employee information, and communication signals to surface insights for executive decision-making. The scope of services is defined in your Order Form or Trial Agreement.

3. Customer Responsibilities

• You are responsible for ensuring you have the necessary rights and consents to upload employee data
• You must maintain the confidentiality of your account credentials
• You must not use the platform for any unlawful purpose or in violation of applicable employment, privacy, or data protection laws
• You must notify us promptly of any unauthorized access to your account

4. Data Ownership

You retain full ownership of all data you upload to AlignEQ. We process your data solely to deliver the Services. We will not disclose your data to third parties except as required by law or as necessary to operate the platform with contracted subprocessors.

5. Acceptable Use

You may not use AlignEQ to:

• Violate any applicable law or regulation
• Infringe intellectual property rights
• Transmit malicious code or interfere with platform integrity
• Attempt to gain unauthorized access to any system or data
• Make employment decisions based solely on automated outputs without human review

6. Trial Terms

Trial access is provided for evaluation purposes only. Trial data is subject to these Terms. We may terminate a trial at any time with reasonable notice. Data is retained for 30 days following trial end, then deleted.

7. Limitation of Liability

To the maximum extent permitted by law, AlignEQ’s liability is limited to the fees paid in the three months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages. AlignEQ outputs are advisory only and do not constitute employment, legal, or medical advice.

8. Changes

We will provide at least 30 days’ notice of material changes to these Terms. Continued use after the effective date constitutes acceptance.
